Zakaat given under the Pretext of a Gift or a Loan

Q: Will the zakaat be fulfilled if it is given under the pretext of a gift or a loan?

A: If the person gave the wealth to the poor person under the pretext of a gift or a loan, but had the intention of discharging his zakaat, the zakaat will be discharged. However, in the case where he gave the wealth under the pretext of a loan, it will be impermissible for him to take back the wealth from the poor person (as the wealth was not a loan but was zakaat). If he takes back the money from the poor person, he will be sinful. He should return the money to the same poor person under some pretext.

(وشرط صحة أدائها نية مقارنة له) أي للأداء

قال العلامة ابن عابدين – رحمه الله -: (قوله نية) أشار إلى أنه لا اعتبار للتسمية فلو سماها هبة أو قرضا تجزيه في الأصح (رد المحتار 2/268)

والعبرة لنية الدافع لا لعلم المدفوع إليه حتى لو قال المحترم وهبت لك هذا الشيء أو أقرضتك وينوي به الزكاة وقع عن الزكاة (الفتاوى البزازية 1/41)

ومن أعطى مسكينا دراهم وسماها هبة أو قرضا ونوى الزكاة فإنها تجزيه، وهو الأصح هكذا في البحر الرائق ناقلا عن المبتغى والقنية (الفتاوى الهندية 1/171)
