Q: Is it permissible to use zakaat funds to purchase hampers and feed the poor? Similarly, is it permissible to provide iftaar for the poor in the month of Ramadhaan using zakaat funds?
A: It is permissible to use zakaat funds to feed the poor provided the requirement of tamleek is found. Tamleek means to transfer ownership of the wealth to a recipient of zakaat. Therefore, if the poor are given the zakaat hampers, the zakaat will be discharged. If the poor are not given the zakaat hampers but are merely invited for a meal and allowed to partake of it, then zakaat will not be discharged since the requirement of tamleek is not found. Similar is the case regarding the iftaar food during the month of Ramadhaan. If the poor are given the iftaar hampers, the zakaat will be discharged. If the poor are not given the iftaar hampers but are merely invited to partake of food provided, then the zakaat will not be discharged since the requirement of tamleek is not found.

ويشترط أن يكون الصرف (تمليكا) لا إباحة كما مر
قال العلامة ابن عابدين – رحمه الله -: قوله ( تمليكا ) فلا يكفي فيها الإطعام إلا بطريق التمليك ولو أطعمه عنده ناويا الزكاة لا تكفي (رد المحتار 2/344)
وقيد بالتمليك احترازا عن الإباحة ولهذا ذكر الولوالجي وغيره أنه لو عال يتيما فجعل يكسوه ويطعمه وجعله من زكاة ماله فالكسوة تجوز لوجود ركنه وهو التمليك وأما الإطعام إن دفع الطعام إليه بيده يجوز أيضا لهذه العلة وإن كان لم يدفع إليه ويأكل اليتيم لم يجز لانعدام الركن وهو التمليك (البحر الرائق 2/217)
رجل يعول يتيما فجعل يكسوه ويطعمه وجعل ما يكسوه وما يأكل عنده من زكاة ماله أما الكسوة يجوز لوجود الركن وهو التمليك وأما الإطعام إن دفع إليه بيده يجوز أيضا لهذا وإن كان لم يدفع ويأكل اليتيم لم يجز لانعدام الركن وهو التمليك (التجنيس والمزيد 2/327)
ويشترط التمليك ولا يجوز التغدية والتعشية (الفتاوى السراجية صـ 156)
