1. In order for the gifting to be valid in shariah, it is a precondition that the one who is gifted the gift, wealth, item, house, etc. accepts the gift and has complete control over it. If the person whom the gift is made over to verbally accepts it but is not given full control over it, or he is unable to deal in it freely due to the one gifting it still maintaining some control over it, then the gifting is not valid.
