Zakaat on a person who has debts

Q: Is zakaat compulsory on a person who possesses the nisaab amount but also has unsettled debts?

A: The principle of shari’at is that after evaluating one’s zakaatable assets one will deduct his liabilities and debts. If the remaining amount reaches the nisaab, zakaat will be fardh.

Examples:

  1. Nisaab: R4, 000; Zakaatable assets: R10, 000; Liabilities: R8, 000; Balance: R2, 000 = Zakaat will not be fardh.
  2. Nisaab: R4, 000; Zakaatable assets: R10, 000; Liabilities: R5, 000; Balance: R5, 000 = Zakaat will be fardh.

فارغ عن دين له مطالب من جهة العباد (الدر المختار 2/260)

ومنها أن لا يكون عليه دين مطالب به من جهة العباد عندنا فإن كان فإنه يمنع وجوب الزكاة بقدره حالا كان أو مؤجلا (بدائع الصنائع 2/6)

ومن كان عليه دين يحيط بماله فلا زكاة عليه وإن كان ماله أكثر من الدين زكى الفاضل إذا بلغ نصابا (مختصر القدوري صـ 51)
