{"id":361,"date":"2011-03-07T15:49:54","date_gmt":"2011-03-07T13:49:54","guid":{"rendered":"http:\/\/ihyaauddeen.co.za\/?p=361"},"modified":"2025-01-21T15:01:55","modified_gmt":"2025-01-21T13:01:55","slug":"the-fifth-problem-that-will-arise-by-referring-directly-to-the-quran-and-hadith","status":"publish","type":"post","link":"https:\/\/ihyaauddeen.co.za\/?p=361","title":{"rendered":"The Fourth Problem that will Arise by Referring Directly to the Qur\u2019an and Hadith"},"content":{"rendered":"<p style=\"text-align: justify;\">The fourth problem is that if the masses are allowed to follow at random whatever they believe to be correct or whoever they feel is on the correct opinion, it will eventually result in many people following their own whims and desires. Most people when faced with a problematic situation opt to follow the opinion of those <em>Muftis<\/em> and <em>Aalims<\/em> through whom their benefits and interests will be secured. In that predicament most people are totally unconcerned about studying the proofs and weighing the arguments. Rather, their main concern is how they can save their image in society or secure their commercial gain. For the sake of convenience they are prepared to hop over to any <em>mazhab<\/em> in order to achieve this objective. One should honestly ponder and contemplate over this crucial situation. Is such a person following <em>Deen<\/em> or following his <em>nafs<\/em>? Will such a person\u2019s actions be in conformity to the verse of the Qur\u2019an: \u0648\u064e\u0644\u064e\u0627 \u062a\u064e\u062a\u064e\u0651\u0628\u0650\u0639\u0650 \u0627\u0644\u0652\u0647\u064e\u0648\u064e\u06cc\u00a0<em>(Do not follow your desires.)<\/em> [26:38] or is his action opposing this law of the Qur\u2019an? There are many glaring examples found in today\u2019s times which highlight this problem. Hereunder a few examples are cited:<\/p>\n<p style=\"text-align: justify;\">A person is caught for exceeding the speed limit. He is given a R2000 fine by the police. He decides to look around to see whether any <em>Aalim <\/em>permits the paying of speeding fines with interest money. He is informed that a certain <em>Aalim <\/em>allows the paying of speeding fines with interest money. So this person feels quite satisfied that he has found some sought of justification for his actions (through the <em>fatwa<\/em> of that specific <em>Aalim<\/em>). But at the same time he is told that you are presently eating prawns. According to the <em>fatwa<\/em> of that very <em>Aalim<\/em>, prawns has been declared <em>Makrooh-e-Tahrimi<\/em>. Hence you should also adhere to the ruling of that <em>Aalim <\/em>in relation to the issue of prawns.<\/p>\n<p style=\"text-align: justify;\">He responds, \u201cThere isn\u2019t only one <em>Aalim <\/em>in the whole world. Don\u2019t you know that so and so <em>Aalim <\/em>(in whose opinion it is impermissible to pay speeding fines with interest money) declared prawns as totally permissible? So I follow that <em>Aalim <\/em>in that issue.\u201d One should consider this situation and honestly answer the following question: Will the one adopting such an approach in these matters as well as all other <em>Deeni <\/em>issues be regarded as a sincere and steadfast Believer, or will he be considered a \u201cFatwa Shopper\u201d and one following his whims and desires? Hence, we conclude from this situation that the one who opts to remain unrestricted, by following what he feels appropriate and correct eventually opposes two verses of the Holy Qur\u2019an:<\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_zumar_39_2.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-365\" title=\"Surah_zumar_39_2\" src=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_zumar_39_2.png\" alt=\"Surah Zumar 39:2\" width=\"363\" height=\"30\" srcset=\"https:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_zumar_39_2.png 363w, https:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_zumar_39_2-300x24.png 300w\" sizes=\"auto, (max-width: 363px) 100vw, 363px\" \/><\/a><\/p>\n<p style=\"text-align: center;\"><em>Worship Allah Ta`ala with sincerity. [39:2]<\/em><\/p>\n<p style=\"text-align: center;\"><em><a href=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/01\/Ayah_26_38.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-227\" title=\"Ayah_26_38\" src=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/01\/Ayah_26_38.jpg\" alt=\"Qur'an: Surah 26 Ayah 38\" width=\"283\" height=\"41\" \/><\/a><\/em><\/p>\n<p style=\"text-align: center;\"><em>Do not follow your desires. [26:38]<\/em><\/p>\n<p style=\"text-align: justify;\">Allamah Ibnul Aabidin<em> (Rahmatullahi Alayh)<\/em> narrated an incident that transpired in the time of Shaikh Abu Bakr Al-Jowzajani <em>(Rahmatullahi Alayh)<\/em>. A <em>Hanafi Aalim<\/em> proposed to marry the daughter of a person who was from the <em>Ahlul-Hadeeth<\/em>. The father refused to accept the proposal unless he agrees to abandon his present <em>mazhab<\/em> and begin practising \u2018<em>Qiraat khalfal-Imaam<\/em>\u2019 (reading qiraat whilst following an<em> Imaam<\/em> in<em> Salaah<\/em>) and \u2018<em>Raf&#8217;ul-Yadain<\/em>\u2019 (i.e. lift his hands before and after <em>ruku<\/em>) etc. The <em>Aalim<\/em> submitted to those conditions and the <em>nikaah<\/em> took place. When Shaikh Abu Bakr was asked regarding this situation he lowered his head and remarked: \u201cI have a fear that the <em>Imaan<\/em> of this man may leave him at the time of his death, due to the fact that he abandoned a practice which he regarded <em>Sunnah<\/em>, and substituted it with a contradictory deed without any <em>Shar&#8217;ee<\/em> reason, but for the sake of securing a woman in <em>nikaah<\/em>.\u201d <a id=\"ref1\" href=\"..\/?p=361\/#1\"><sup>[1]<\/sup><\/a><\/p>\n<p><!--more--><\/p>\n<p style=\"text-align: justify;\">Moulana Ashraf Ali Thanwi <em>(Rahmatullahi Alayh)<\/em> narrates a similar incident. He says:\u201cThere is a village near our area, wherein a man married a certain woman. Later it was learnt that both of them were breastfed by the same woman (thus being foster brother and sister). A person came to enquire from me what was to be done about the matter. I explained to him that this marriage is not correct, and that they should be separated. He remarked: \u2018This is going to be a source of immense disgrace. Please find a way for its permissibility?\u2019 I said to him: \u2018Firstly! There is no disgrace in separation. Rather, in living together, there will be immense disgrace, because people will say that you have united a brother and sister (in marriage). Secondly, even if there is disgrace, then let it be. When this is the command of the <em>Shari`ah<\/em>, then there is no question of disgrace.\u2019 The man began to say: \u2018But he drank the milk in infancy and then immediately vomited it out.\u2019 So I told him: \u2018Whether he vomited it out or not, the law does not change.\u2019<\/p>\n<p style=\"text-align: justify;\">\u2018After receiving a clear answer from me, they proceeded to Delhi. There they found a man who claims to practise on <em>Hadith<\/em> only, (without following a <em>mazhab<\/em>). It is not my object right now to discuss him. Hence, to achieve their aim, they went to this person to see if their object could be fulfilled. That person issued a verdict that if he has consumed less than five sips, she does not become impermissible for him (to marry).<\/p>\n<p style=\"text-align: justify;\">They immediately wrote out a questionnaire stating that a man drank two sips of milk from a woman during infancy. Does she become his foster mother? The answer was written (by that person) with the <em>Hadith<\/em>:\u0644\u0627 \u062a\u062d\u0631\u0645 \u0627\u0644\u0645\u0635\u0629 \u0648\u0644\u0627 \u0627\u0644\u0645\u0635\u062a\u0627\u0646 \u00a0(One or two sips do not create prohibition.), whereas this <em>Hadith<\/em> had been abrogated through the verse of the Holy Qur\u2019an:<\/p>\n<p style=\"text-align: center;\"><a href=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_Nisa_4_24.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-368\" title=\"Surah_Nisa_4_24\" src=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_Nisa_4_24.png\" alt=\"Surah Nisa 4:24\" width=\"649\" height=\"76\" srcset=\"https:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_Nisa_4_24.png 649w, https:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_Nisa_4_24-300x35.png 300w, https:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/03\/Surah_Nisa_4_24-630x73.png 630w\" sizes=\"auto, (max-width: 649px) 100vw, 649px\" \/><\/a><em>(Forbidden upon you are your mothers, daughters, sisters, paternal aunts, maternal aunts, nieces [brother\u2019s daughters and sister\u2019s daughters], your foster mothers, and foster sisters.) [4:24]<\/em><\/p>\n<p style=\"text-align: justify;\">The man became very happy and proceeded to the husband and wife and handed the <em>Fatwa<\/em> over to them saying: \u2018This after all is also an <em>Aalim\u2019s<\/em> fatwa.
