{"id":323,"date":"2011-02-28T16:53:27","date_gmt":"2011-02-28T14:53:27","guid":{"rendered":"http:\/\/ihyaauddeen.co.za\/?p=323"},"modified":"2025-01-21T15:02:04","modified_gmt":"2025-01-21T13:02:04","slug":"the-third-problem-that-will-arise-by-referring-directly-to-the-quran-and-hadith","status":"publish","type":"post","link":"https:\/\/ihyaauddeen.co.za\/?p=323","title":{"rendered":"The Third Problem that will Arise by Referring Directly to the Qur\u2019an and Hadith"},"content":{"rendered":"<p style=\"text-align: justify;\">The third problem is that some people will come across certain <em>Ahaadith<\/em> which have been unanimously abrogated (i.e. according to the consensus of the Sahaabah <em>(Radiyallahu Anhum)<\/em> and the entire <em>ummah<\/em>),  however due to lack of sufficient knowledge regarding the historical background of the law, they will begin practising upon it.<\/p>\n<p style=\"text-align: justify;\">Consider the <em>Hadith<\/em> which permits the practice of<em> mut&#8217;ah<\/em> <a id=\"ref1\" href=\"..\/?p=323\/#1\">[1]<\/a>. Undoubtedly, for a limited time the Sahaabah <em>(Radiyallahu Anhum)<\/em> were allowed to practise mut&#8217;ah in the noble era of Rasulullah <em>(Sallallahu Alayhi Wasallam)<\/em> during <em>jihaad<\/em>. However, this permissibility was later on abrogated by the law of prohibition. If anyone independently studies the classical works of the <em>Muhadditheen<\/em>, viz. Saheeh Bukhaari, Saheeh Muslim as well as other compilations of Hadith, he will conclude that it is permissible for one to practise mut&#8217;ah, since the <em>Hadith<\/em> which mentions its permissibility is recorded in these books.<\/p>\n<p>The following narration appears in Saheeh Muslim 1\/450:<\/p>\n<p style=\"text-align: center;\">\u0639\u0646 \u062c\u0627\u0628\u0631 \u0628\u0646 \u0639\u0628\u062f \u0627\u0644\u0644\u0647 \u0648 \u0633\u0644\u0645\u0629 \u0628\u0646 \u0627\u0644\u0623\u0643\u0648\u0639 \u0642\u0627\u0644\u0627 \u062e\u0631\u062c \u0639\u0644\u064a\u0646\u0627 \u0645\u0646\u0627\u062f\u064a \u0631\u0633\u0648\u0644 \u0627\u0644\u0644\u0647 \u2013 \u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645 &#8211; \u0641\u0642\u0627\u0644 : \u0625\u0646 \u0631\u0633\u0648\u0644 \u0627\u0644\u0644\u0647 \u2013\u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645 &#8211; \u0642\u062f \u0623\u0630\u0646 \u0644\u0643\u0645 \u0623\u0646 \u062a\u0633\u062a\u0645\u062a\u0639\u0648\u0627 \u064a\u0639\u0646\u064a \u0645\u062a\u0639\u0629 \u0627\u0644\u0646\u0633\u0627\u0621<\/p>\n<p style=\"text-align: center;\"><em>Jabir bin Abdullah and Salimah bin Akwa` report: \u201cA person came out to us and announced, \u2018Indeed Rasulullah (Sallallahu Alayhi Wasallam) has granted you permission to engage in mut&#8217;ah.\u2019\u201d<\/em><\/p>\n<p>This Hadith was later on abrogated by many other Ahaadith <a id=\"ref2\" href=\"..\/?p=323\/#2\">[2]<\/a>.<\/p>\n<p style=\"text-align: justify;\">From this example we can well imagine the disastrous outcome of those who refer directly to the Qur\u2019an and <em>Hadith<\/em>. They will eventually end up following abrogated <em>Ahaadith<\/em>. It should be understood that merely finding a <em>Hadith<\/em> recorded in Bukhaari or Muslim or any other compilation of <em>Hadith<\/em> will not allow one to practise upon it. Just as there are certain verses recorded in the Qur\u2019an which are unanimously abrogated <sup><a id=\"ref3\" href=\"..\/?p=323\/#3\">[3]<\/a><\/sup>, similarly there are many authentic <em>Ahaadith <\/em>contained in the books of<em> Hadith<\/em> (viz. Saheeh Bukhaari, Saheeh Muslim, etc.) which are also unanimously abrogated. The reason for these<em> Ahaadith<\/em> being recorded in these books was in order to prove that this law existed in the earlier era of Islam.<\/p>\n<p style=\"text-align: justify;\">Hence, we conclude that any<em> Hadith<\/em> found in the various books of<em> Hadith<\/em> will not necessarily qualify it to be practised upon. Instead one will have to verify whether Rasulullah <em>(Sallallahu Alayhi Wasallam)<\/em> continued practising upon it till the end of his life or prior to the demise of  Rasulullah <em>(Sallallahu Alayhi Wasallam)<\/em> it was abrogated.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<h3 style=\"text-align: justify;\">Combining two Salaahs in one&#8217;s Home town without a valid Reason<\/h3>\n<p style=\"text-align: justify;\">Consider the law of joining Salaahs under normal circumstances (i.e. without any shar&#8217;ee excuse and whilst one is residing in his home town). The Sahaabah <em>(Radiyallahu Anhum)<\/em> as well as the entire ummah for many centuries of Islam were unanimous that it is impermissible for one under normal circumstances to join <em>Salaahs<\/em>. The<em> Hadith<\/em> of Rasulullah <em>(Sallallahu Alayhi Wasallam)<\/em> recorded in Tirmizi is explicit in this regard:<\/p>\n<p><!--more--><\/p>\n<p style=\"text-align: center;\">\u0639\u0646 \u0627\u0628\u0646 \u0639\u0628\u0627\u0633 \u0639\u0646 \u0627\u0644\u0646\u0628\u064a \u2013 \u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645 \u2013 \u0642\u0627\u0644 \u0645\u0646 \u062c\u0645\u0639 \u0628\u064a\u0646 \u0627\u0644\u0635\u0644\u0627\u062a\u064a\u0646 \u0645\u0646 \u063a\u064a\u0631 \u0639\u0630\u0631 \u0641\u0642\u062f \u0623\u062a\u0649 \u0628\u0627\u0628\u0627 \u0645\u0646 \u0623\u0628\u0648\u0627\u0628 \u0627\u0644\u0643\u0628\u0627\u0626\u0631<\/p>\n<p style=\"text-align: center;\"><em>Ibnu Abbas (Radiyallahu Anhuma) reports that Nabi (Sallallahu Alayhi Wasallam) said: \u201cWhoever combines two Salaahs without a valid reason has indeed committed a major sin.\u201d (Tirmizi 1\/48) <\/em> <a id=\"ref4\" href=\"..\/?p=323\/#4\"><sup>[4]<\/sup><\/a><\/p>\n<p style=\"text-align: justify;\">However, we notice that there is another Hadith recorded by Imaam Tirmizi <em>(Rahmatullahi Alayh)<\/em> under the chapter: <em>\u201cChapter regarding the combining of two Salaahs\u201d<\/em> which states:<\/p>\n<p style=\"text-align: center;\">\u0639\u0646 \u0627\u0628\u0646 \u0639\u0628\u0627\u0633 \u0642\u0627\u0644 : \u062c\u0645\u0639 \u0631\u0633\u0648\u0644 \u0627\u0644\u0644\u0647 \u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645 \u0628\u064a\u0646 \u0627\u0644\u0638\u0647\u0631 \u0648\u0627\u0644\u0639\u0635\u0631 \u0648\u0628\u064a\u0646 \u0627\u0644\u0645\u063a\u0631\u0628 \u0648\u0627\u0644\u0639\u0634\u0627\u0621 \u0628\u0627\u0644\u0645\u062f\u064a\u0646\u0629 \u0645\u0646 \u063a\u064a\u0631 \u062e\u0648\u0641 \u0648\u0644\u0627 \u0645\u0637\u0631 \u0642\u0627\u0644 \u0641\u0642\u064a\u0644 \u0644\u0627\u0628\u0646 \u0639\u0628\u0627\u0633 \u0645\u0627 \u0623\u0631\u0627\u062f \u0628\u0630\u0644\u0643 \u00a0\u0642\u0627\u0644 \u0623\u0631\u0627\u062f \u0623\u0646 \u0644\u0627 \u064a\u062d\u0631\u062c \u0623\u0645\u062a\u0647<\/p>\n<p style=\"text-align: center;\"><em>Ibnu Abbas (Radiyallahu Anhuma) stated: \u201cNabi (Sallallahu Alayhi Wasallam) combined the Zuhr Salaah with the Asr Salaah and the Maghrib Salaah with the Esha Salaah in Madinah Munawwarah without any excuse neither the excuse of  fear nor rain.\u201d Ibnu Abbas (Radiyallahu Anhuma) was then questioned : \u201cWhy did Nabi (Sallallahu Alayhi Wasallam) do that?\u201d He replied: \u201cHe did this so as not to inconvenience his ummah.\u201d (Tirmizi 1\/47)<\/em><\/p>\n<p style=\"text-align: justify;\">Imaam Tirmizi <em>(Rahmatullahi Alayh)<\/em> commentating upon this<em> Hadith<\/em> declares: \u201cThis <em>Hadith<\/em> (the apparent meaning of this <em>Hadith <\/em>i.e.\u00a0performing two <em>Salaahs<\/em> in one time whilst residing in one&#8217;s home town) is not practised by anybody. <a id=\"ref5\" href=\"..\/?p=323\/#5\">[5]<\/a>\u201d Hence, we understand that the entire <em>ummah<\/em> has agreed upon the fact that it is impermissible for one to practise upon the apparent meaning of this <em>Hadith<\/em>. Yet we find in this present age and time, a group of people who practise upon this abrogated <em>Hadith<\/em>. So if someone wishes to follow whatever he comes across in the <em>Hadith<\/em> without examining its true position in<em> Deen<\/em>, he will certainly end up following abrogated <em>Ahaadith<\/em>. Such a person will consider himself as having done a great service to<em> Deen<\/em>. He will regard himself to be a reviver of a \u2018dead Sunnah\u2019 which nobody practised upon. However, the sad reality is that such a person has strayed from the straight path by following what the entire <em>ummah<\/em>, from the time of the Sahaabah<em> (Radiyallahu Anhum)<\/em>, has regarded as abrogated. He has rejected the path followed unanimously by the entire <em>ummah<\/em>.<\/p>\n<p style=\"text-align: justify;\">Allah Ta&#8217;ala declares in the Holy Qur\u2019an:<\/p>\n<p style=\"text-align: center;\"><a href=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/02\/Surah_nisaa_4_115.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-332\" title=\"Surah_nisa_4_115\" src=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/02\/Surah_nisaa_4_115.png\" alt=\"Surah Nisa 4:115\" width=\"629\" height=\"63\" srcset=\"https:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/02\/Surah_nisaa_4_115.png 629w, https:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/02\/Surah_nisaa_4_115-300x30.png 300w\" sizes=\"auto, (max-width: 629px) 100vw, 629px\" \/><\/a><\/p>\n<p style=\"text-align: center;\"><em>Whoever opposes the Rasul (Sallallahu Alayhi Wasallam) after the guidance was manifest to him and he follows a path other than that of the believers then We shall leave him in the path he has chosen and We will enter him into Jahannum. What an evil abode! (Surah Nisa 4:115)<\/em><\/p>\n<p style=\"text-align: justify;\">At this juncture, it is extremely important that we understand that a discontinued practice no longer remains a <em>Sunnah<\/em> or part of <em>Deen<\/em>. Especially in the case where one is aware of the fact that the common practice of the Sahaabah <em>(Radiyallahu Anhum)<\/em> as well as the entire <em>ummah<\/em> opposes it. What then gives one the authority to practise upon it? Furthermore, the <em>Hadith <\/em>of Rasulullah <em>(Sallallahu Alayhi Wasallam)<\/em> sufficiently elucidates this point.<\/p>\n<p style=\"text-align: center;\">\u0645\u0646 \u0634\u0630 \u0634\u0630 \u0641\u064a \u0627\u0644\u0646\u0627\u0631<\/p>\n<p style=\"text-align: center;\"><em>Whoever adopts an independent path will also be alone in Jahannum. (Haakim 1\/115) <\/em><\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><a id=\"1\" href=\"#ref1\">[1]<\/a> <em>Mut&#8217;ah<\/em> refers to a temporary marriage that was initially allowed for <em>mujaahids<\/em> who were out in <em>jihaad<\/em> and it was later abrogated. A proper <em>nikaah<\/em> would be performed with the woman in the presence of witnesses and with <em>mahr<\/em>.<\/p>\n<p DIR=\"RTL\" style=\"text-align: justify;\"><a id=\"2\" href=\"#ref2\">[2]<\/a> \u0639\u0646 \u0625\u064a\u0627\u0633 \u0628\u0646 \u0633\u0644\u0645\u0629 \u0639\u0646 \u0623\u0628\u064a\u0647 \u0642\u0627\u0644 \u0631\u062e\u0635 \u0631\u0633\u0648\u0644 \u0627\u0644\u0644\u0647 \u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645 \u0639\u0627\u0645 \u0623\u0648\u0637\u0627\u0633 \u0641\u064a \u0627\u0644\u0645\u062a\u0639\u0629 \u062b\u0644\u0627\u062b\u0627 \u062b\u0645 \u0646\u0647\u064a \u0639\u0646\u0647\u0627<\/p>\n<p style=\"text-align: center;\"><em>Iyaas ibnu Salmah reports from his father that Rasulullah (Sallallahu Alyhi Wasallam) permitted the Sahaba (Radiyallahu Anhum) on the year of Awtaas (on the occasion of the conquest of Makkah) to practise mut&#8217;ah for three days, thereafter Rasulullah (Sallallahu Alyhi Wasallam) prohibited them forever.  (Saheeh Muslim 1\/451)<\/em><\/p>\n<p style=\"text-align: justify;\"><a id=\"3\" href=\"#ref3\">[3]<\/a> This refers to those verses whose laws have been abrogated and replaced with other laws though the recitation of those verses has not been abrogated. An example of this would be the Ayah regarding jihaad:<\/p>\n<p style=\"text-align: center;\"><a href=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/02\/\u064dSurah_nisaa_4_77.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-342\" title=\"\u064dSurah_nisaa_4_77\" src=\"http:\/\/ihyaauddeen.co.za\/wp-content\/uploads\/2011\/02\/\u064dSurah_nisaa_4_77.png\" alt=\"Surah Nisaa 4:77\" width=\"242\" height=\"29\" \/><\/a><\/p>\n<p style=\"text-align: center;\"><em>Restrain your hands from jihaad and establish Salaah and discharge zakaat (Surah Nisa 4:77)<\/em><\/p>\n<p style=\"text-align: justify;\">This law existed at the beginning of Islam when the Sahaba <em>(Radiyallahu Anhum) <\/em>were not permitted to wage war against the <em>kuffaar<\/em>.
