{"id":316,"date":"2011-02-16T16:48:11","date_gmt":"2011-02-16T14:48:11","guid":{"rendered":"http:\/\/ihyaauddeen.co.za\/?p=316"},"modified":"2025-01-21T15:02:14","modified_gmt":"2025-01-21T13:02:14","slug":"the-second-problem-that-will-arise-be-referring-directly-to-the-quran-and-hadith","status":"publish","type":"post","link":"https:\/\/ihyaauddeen.co.za\/?p=316","title":{"rendered":"The Second Problem that will Arise by Referring Directly to the Qur&#8217;an and Hadith"},"content":{"rendered":"<p style=\"text-align: justify;\">The second problem is that some people, after independently viewing the laws of the Qur\u2019an and Hadith (with their limited analogy), will begin to deduce underlying factors <em>(&#8216;ilal)<\/em> upon which rulings are based. Thereafter, they will abrogate many laws of <em>Deen<\/em> on the basis that the underlying cause that they deduced no more exists.<\/p>\n<p style=\"text-align: justify;\">For instance, consider the law of performing <em>wudhu<\/em> before every<em> Salaah<\/em>. In this time and age, a group of modernists hold the view that there is no need to perform wudhu before every<em> Salaah<\/em>, since our limbs are mostly covered and do not get dirty. They contend that the law of<em> wudhu<\/em> was most relevant to the Sahaabah <em>(Radiyallahu Anhum)<\/em>. Many of the Sahaabah <em>(Radiyallahu Anhum)<\/em> were shepherds or worked on the fields and in other outdoor occupations. As a result, their bodies became soiled in dust and dirt. Therefore, they were required to make wudhu for every <em>Salaah<\/em>. Hence, this group of modernists subjected the law of wudhu to their flawed analogy.<\/p>\n<p style=\"text-align: justify;\">A similar example is that of the law of appointing witnesses at the time of <em>nikaah<\/em>. Rasulullah <em>(Sallallahu Alayhi Wasallam)<\/em> has declared:<\/p>\n<p style=\"text-align: center;\">\u0644\u0627 \u0646\u0643\u0627\u062d \u0625\u0644\u0627 \u0628\u0634\u0647\u0648\u062f<\/p>\n<p style=\"text-align: center;\"><em> There is no nikaah without witnesses. (Bayhaqi 7\/111)<\/em><\/p>\n<p style=\"text-align: justify;\">Based on this and other <em>Ahaadith<\/em>, the scholars have unanimously stated that the <em>nikaah<\/em> must be witnessed by at least two people, otherwise it will not be valid.<\/p>\n<p style=\"text-align: justify;\">Yet, some modernists opine that <em>nikaah <\/em>is valid regardless of whether witnesses are present or not. They comment upon the aforementioned <em>Hadith<\/em> that witnesses were only deemed necessary in the <em>Hadith<\/em> in order to alleviate any misunderstanding or denial if they cropped up later on during the <em>nikaah<\/em>. However, they claim that nowadays the <em>nikaah<\/em> is properly recorded and signed by both parties. Therefore, witnesses are not necessary.
