Hazrat Abu Qataadah (radhiyallahu anhu) reports that Rasulullah (sallallahu alaihi wasallam) was asked regarding (the virtue of) fasting on the Day of `Aashuraa (tenth of Muharram). Rasulullah (sallallahu alaihi wasallam) replied, “It (fasting on the Day of `Aashuraa) wipes out the sins of the past year.”

Is it permissible for him not to fast for that day?

A: Fasting is compulsory upon a person who at the time of subah saadiq is not a musaafir. Hence, since the person is still present in his hometown at the time of subah saadiq (and only intends to travel later on during the day), fasting for that day is compulsory upon him. The concession of a musaafir (of not fasting) does not apply to him. Hence, if he does not fast on that day, he will be sinful.

ومنها السفر الذي يبيح الفطر وهو ليس بعذر في اليوم الذي أنشأ السفر كذا في الغياثية فلو سافر نهارا لايباح له الفطر في ذلك اليوم وإن أفطر لا كفارة عليه بخلاف ما لو أفطر ثم سافر كذا في محيط السرخسي (الفتاوى الهندية ج1 ص206)

(وللمسافر الذي أنشا السفر قبل طلوع الفجر إذ لايباح له الفطر بإنشائه بعد ما أصبح صائما بخلاف ما لو حل له مرض بعده فله (الفطر) لقوله تعالى فمن كان منكم مريضا أو على سفر فعدة من أيام أخر … (وصومه) أي المسافر (أحب إن لم يضره) لقوله تعالى: ,أن تصوموا خير لكم (مراقي الفلاح ص686)

A: It is makrooh for a fasting person to burn lawbaan or incense sticks in the musjid or anywhere else, due to the fear that he will inhale the smoke. Inhaling the smoke intentionally will nullify the fast.

A: It is not compulsory for a Musaafir to fast while travelling. Shari’ah has granted a Musaafir concession to not fast and to make up for the missed fast upon returning home after the month of Ramadhaan. However, if the Musaafir is able to fast during his journey, then this is better and more rewarding.

و يندب لمسافر الصوم إن لم يضره فإن شق عليه أو على رفيقه فالفطر أفضل (الدر المختار ج2 ص42)

ومنها السفر الذي يبيح الفطر وهو ليس بعذر في اليوم الذي أنشأ السفر كذا في الغياثية (الفتاوى الهندية ج1 ص206)

Q: Whilst fasting, if the nose begins to bleed, will the fast break?

A: In the case where the blood does not go down the nasal passage, the fast will not break. If the blood flowed down the nasal passage and entered the throat then it will be seen whether the blood was more than the saliva or less than it. If the blood was more than the saliva or equal to it then the fast will break. If the blood was less than the saliva then the fast will not break.

ولو أكل دما في ظاهر الرواية عليه القضاء دون الكفارة لأنه مما يستقذره الطبع كذا في الظهيرية (الفتاوى الهندية ج1 ص203)

خرج الدم من بين أسنانه ودخل حلقه يعني ولم يصل إلى جوفه أما إذا وصل فإن غلب الدم أو تساويا فسد وإلا لا … قال الشامي: قلت ومن هذا يعلم حكم من قلع ضرسه في رمضان ودخل الدم إلى جوفه في النهار ولو نائما فيجب عليه القضاء (رد المحتار على در المختار ج2 ص396)

A: If medication or any moist substance is inserted into the private organ of a fasting woman the fast will be nullified. However, if a dry object is inserted during the medical examination the fast will not be nullified. If a dry object was inserted and removed and thereafter re-inserted whilst moist the fast will be nullified.

أو أدخل إصبعه اليابسة فيه أي دبره أو فرجها ولو مبتلة فسد (در المختار ج2 ص397)

ولو أدخل إصبعه في استه والمرأة في فرجها لا يفسد وهو المختار إلا إذا كانت مبتلة بالماء أو الدهن فحينئذ يفسد لوصول الماؤ أو الدهن (الفتاؤى الهندية ج1 ص204)

A: Using the inhaler (pump) while fasting will nullify the fast as the inhaler contains medication. Through one orally taking medication while fasting or one taking medication through the nasal passage, one’s fast will break. However, it will only be waajib (compulsory) for one to keep qadha for the broken fast.

وما وصل إلى الجوف أو إلى الدماغ من المخارق الأصلية كالأنف والأذن والدبر بأن استعط أو احتقن أو أقطر في أذنه فوصل إلى الجوف أو إلى الدماغ فسد صومه (بدائع الصنائع ج2 ص 93)

A: If one is unable to continue the fast, then it is permissible for him to break the fast and make qadha of the broken fast after Ramadhaan. Kaffarah will not be compulsory upon him.

المريض إذا خاف على نفسه التلف أو ذهاب عضو يفطر بالإجماع وإن خاف زيادة العلة وامتداده فكذلك وعليه القضاء إذا أفطر كذا في المحيط (الفتاوى الهندية ج1 ص207)

A: Fasting in the month of Ramadhaan is a great obligation and a salient feature of Islam. To openly eat and drink during the month of Ramadhaan is tantamount to showing disregard to the salient feature of Islam and a major sin. If the one who does not fast and openly eats and drinks regards it as a sin but does so due to weakness of Imaan he will be guilty of committing a major sin but will not come out of the fold of Islam. If he believes that there is no sin in what he is doing then such a person has regarded this salient feature of Islam as insignificant. Hence this will render him out of the fold of Islam.

ولو أكل عمدا شهرة بلا عذر يقتل و تمامه في شرح الوهبانية قال في الوهبانية : ولو أكل الإنسان عمدا و شهرة ولا عذر فيه قيل بالقتل يؤمر قال الشرنبلالي صورتها: تعمد من لا عذر له الإكل جهارا يقتل لأنه مستهزئ بالدين أو منكر (ردالمحتار على در المختار ج2 ص413)

A: It is permissible to use eye-drops while fasting. The fast will not be nullified. However, using ear-drops and nose-drops while fasting is impermissible and will nullify the fast.

(أو ادهن أو اكتحل أو احتجم) وإن وجد طعمه في حلقه قال في الشامية : أي طعم الكحل أو الدهن كما في السراج و كذا لو بزق فوجد لونه في الأصح بحر قال في النهر لأن الموجود في حلقه أثر داخل من المسام الذي هو خلل البدن والمفطر إنما هو الداخل من المنافذ (رد المحتار على در المختار ج2 ص395)

(أو احتقن أو استعط) في أنفه شيئا (أو أقطر في أذنه دهنا …) فوصل الداء حقيقة إلى جوفه أو دماغه (در المختار ج2 ص402)

ولو أقطر شيئا من الداء في عينه لايفطر صومه عندنا وإن وجد طعمه في حلقه وإذا بزق فرأى أثر الكحل ولونه في بزاقه عامة المشايخ على أنه لايفسد صومه كذا في الذخيرة وهو الأصح كذا في التبيين (الفتاوى الهندية ج1ص203)

ومن احتقن أو استعط أوأقطر في أذنه دهنا أفطر ولاكفارة عليه هكذا في الهداية ولو دخل الدهن بغير صنعه فطره كذا في محيط السرخسي (الفتاوى الهندية ج1ص204)

(وإن أفطر خطأ كأن تمضمض فسبقه الماء قال في الشامي: (قوله وإن أفطر خطأ) شرط جوابه قوله التي قضى فقط وهذا شروع في القسم الثاني وهو ما يوجب القضاء دون الكفارة … (قوله فسبقه الماء) أي يفسد صومه إن كان ذاكرا له (رد المحتار على در المختار ج2 ص401)

وإن تمضمض أو استنشق فدخل الماء جوفه إن كان ذاكرا لصومه فسد صومه وعليه القضاء (الفتاوى الهندية ج1 ص203)

A: The fast will now become nullified. Only Qadha will be Waajib.

(وإن أفطر خطأ) كأن تمضمض فسبقه الماء أو شرب نائما أو تسحر أو جامع على ظن عدم الفجر (أو) أوجر (مكرها) أو نائما وأما حديث رفع الخطأ فالمراد رفع الإثم وفي التحرير المؤاخذة بالخطأ جائزة عندنا خلافا للمعتزلة (أو أكل) أو جامع (ناسيا) أو احتلم أو أنزل بنظر أو ذرعه القيء ( فظن أنه أفطر فأكل عمدا ) للشبهة

قال العلامة ابن عابدين – رحمه الله -: (قوله للشبهة) علة للكل قال في البحر وإنما لم تجب الكفارة بإفطاره عمدا بعد أكله أو شربه أو جماعه لأنه ظن في موضع الاشتباه بالنظير (رد المحتار 2/401)

لو أكل أو شرب أو جامع ناسيا وظن أن ذلك فطره فأكل متعمدا لاكفارة عليه (الفتاوى الهندية 1/206)

ولو أكل أو شرب أو جامع ناسيا أو ذرعه القيء فظن أن ذلك يفطر فأكل بعد ذلك متعمدا فعليه القضاء ولا كفارة عليه لأن الشبهة ههنا استندت إلى ما هو دليل في الظاهر لوجود المضاد للصوم في الظاهر وهو الأكل والشرب والجماع حتى قال مالك بفساد الصوم بالأكل ناسيا (بدائع الصنائع 2/100)

(ومن أكل في رمضان ناسيا وظن أن ذلك يفطره فأكل بعد ذلك متعمدا عليه القضاء دون الكفارة) لأن الاشتباه استند إلى القياس فتحقق الشبهة وإن بلغه الحديث وعلمه فكذلك في ظاهر الرواية (الهداية 1/127)

أكل ناسيا فظن الفطر ثم تعمد الأكل لا كفارة عليه وإن بلغه الخبر في الصحيح (الفتاوى البزازية 2/1)

(وأكل ناسيا) صومه (فظن أنه أفطر فأكل عمدا) فيجب القضاء لوصول الفطر ولا تجب الكفارة لأن صومه فسد قياسا فصار ذلك شبهة فإن كان بلغه الحديث وهو قوله عليه الصلاة والسلام من نسي وهو صائم فأكل أو شرب فليتم صومه فإنما أطعمه الله وسقاه وعلم أن صومه لا يفسد في النسيان روي عن الإمام أنه لا كفارة عليه وهو الصحيح خلافا لهما (مجمع الأنهر 1/243)

A: The fast will not break by forgetfully eating or drinking.

(إذا أكل الصائم أو شرب أو جامع) حال كونه (ناسيا) في الفرض والنفل (الدر المختار 2/394)

إذا أكل الصائم أو شرب أو جامع ناسيا لم يفطر ولا فرق بين الفرض والنفل كذا في الهداية (الفتاوى الهندية 1/202)

(فإن أكل الصائم أو شرب أو جامع ناسيا أو احتلم أو أنزل بنظر أو ادهن أو احتجم أو اكتحل أو قبل أو دخل حلقه غبار أو ذباب وهو ذاكر لصومه أو أكل ما بين أسنانه أو قاء وعاد لم يفطر) أما إذا أكل أو شرب أو جامع ناسيا فالقياس أن يفطر وهو قول مالك لوجود ما يضاد الصوم فصار كالكلام ناسيا في الصلاة وكترك النية فيه وكالجماع في الإحرام أو الاعتكاف ولنا ما رواه أبو هريرة رضي الله عنه أنه قال من نسي وهو صائم فأكل أو شرب فليتم صومه فإنما أطعمه الله وسقاه قال في المنتقى رواه الجماعة إلا النسائي ولأن النسيان غالب للإنسان فلو كان مفطرا لحرجوا وهو مدفوع بالنص بخلاف الإحرام في الحج والصلاة والاعتكاف لأن حالته مذكرة وهذا لأن هيئته في هذه الأشياء تخالف هيئة العادة وفي الصوم لا تخالف فلا مذكر له فيه (تبيين الحقائق 1/322)

A: If whilst fasting, the smoke was inhaled unintentionally the fast will not break. If the smoke was inhaled intentionally the fast will break. Only Qadha will be Waajib.

(أو دخل حلقه غبار أو ذباب أو دخان ) ولو ذاكرا استحسانا لعدم إمكان التحرز عنه ومفاده أنه لو أدخل حلقه الدخان أفطر أي دخان كان ولو عودا أو عنبرا لو ذاكرا لإمكان التحرز عنه قال في الشامي: أي بأي صورة كان الإدخال حتى لو تبخر ببخور فآواه إلى نفسه واستمه ذاكرا لصومه أفطر لإمكان التحرز عنه (رد المحتار على در المختار ج2 ص395)

(أو دخل حلقه دخان بلا صنعه) لعدم قدرته على الامتناع عنه فصار كبلل بقي في فمه بعد المضمضة لدخوله من الأنف إذا أطبق الفم وفيما ذكرنا إشارة إلى من أدخل بصنعه دخانا حلقه بأي صورة كان الإدخال فسد صومه سواء كان دخان عنبر أو عود أو غيرهما (مراقي الفلاح ص660)

A: Smoking in the state of fasting nullifies the fast. It will be waajib (compulsory) upon one to keep qadha for the broken fast as well as kaffarah.

ومفاده أنه لو أدخل حلقه الدخان أي دخان كان ولو عودا أو عنبرا لو ذاكرا لإمكان التحرز عنه قال في الشامي: اي بأي صورة كان الإدخال حتى لو تبخر ببخور فآواه إلى نفسه واشتمه ذاكرا لصومه أفطر لإمكان التحرز عنه (رد المحتار على در المختار ج2 ص395)

ويظهر من ذلك أن مرادهم بما يتغذى به ما يكون فيه صلاح البدن بأن كان مما يؤكل عادة على قصد التغذي أو التداوي أو التلذذ (رد المحتار على در المختار ج2 ص410)

A: A person who is terminally ill and is unable to fast will compensate by giving fidyah for each missed fast. The amount of fidyah is equal to Sadaqatul fitr. If the person recovers from the illness then it will be obligatory on him to make Qadha of the missed fasts.

فالشيخ الفاني الذي لايقدر على الصيام يفطر ويطعم لكل يوم مسكينا كما يطعم في الكفارة (الفتاوى الهندية ج2 ص207)

(ولو مات و عليه صلوات فائتة وأوصى بالكفارة يعطي لكل صلوة نصف صاع من بر) كالفطرة (وكذا حكم الوتر) والصوم (در المختار ج2 ص72)

(وللشيخ الفاني العاجز عن الصوم الفطر ويفدي) وجوبا ولو بأول الشهر قال في الشامي: أي الذي فنيت قوته أو أشرف على الفناء ولذا عرفوه بأنه الذي كل يوم في نقص إلى أن يموت ومثله ما في القهستاني عن الكرماني المريض إذا تحقق اليأس من الصحة فعليه الفدية لكل يوم من المرض نهر (رد المحتار على در المختار ج2 ص427)

A: If one masturbates whilst fasting the fast will be nullified. Only Qadha will be Waajib.

NB: It is impermissible for a person to take enjoyment through masturbation or any haraam activity.

(وكذا الاستمناء بالكف) أي في كونه لايفسد لكن هذا إذا لم ينزل أما إذا أنزل فعليه القضاء كما يصرح به وهو المختار (رد المحتار 2/399)

الصائم إذا عالج ذكره حتى أمنى فعليه القضاء وهو المختار وبه قال عامة المشايخ (الفتاوى الهندية 1/205)

الصائم إذا عالج ذكره حتى أمنى يجب عليه القضاء، وهو المختار كذا في التجنيس والولوالجية وبه قال عامة المشايخ كذا في النهاية (البحر الرائق 2/293)

A: Whilst fasting just as it is impermissible to indulge in sexual activities similarly it is impermissible to fantasize about sexual activities. As far as looking at pornography is concerned it is totally prohibited in Sharee’at. Committing these major sins in the state of fasting destroys the reward of the fast completely. However, if a person ejaculates due to fantasizing or looking at pornography the fast will not break.

(أو احتلم أو أنزل بنظر) ولو إلى فرجها مرارا أو بفكر إن طال (در المختار ج2 ص396)

وإذا نظر إلى امرأة بشهوة في وجهها أو فرجها كرر النظر أو لا لايفطر إذا أنزل كذا في فتح القدير كذا لايفطر بالفكر إذا إمنى هكذا في السراج الوهاج (الفتاوى الهندية ج1 ص204)

(أو أنزل بنظر) إلى فرج امرأته لم يفسد (أو فكر وإن أدام النظر والفكر) حتى أنزل لأنه لم يوجد منه صورة الجماع وهو الإنزال عن مباشرة (مراقي الفلاح ص658)
